Disability Discrimination Act

If an employee has a disability (as defined by the Act) they cannot be refused employment, dismissed or given less favourable conditions unless the employer has made all reasonable attempts to make adjustments, restrictions or modifications to their work and environment.

If an employee believes they have been discriminated against, they may be able to take their employer to a tribunal. Compensation awards in discrimination cases can be very high.

How can we help?

The definitions of disability in the Act are not straightforward. We can assess your employee and advise whether the Act might apply and what sorts of restrictions, adjustments or modifications might be reasonable.
